On April 18, the plaintiff, before undergoing a colonoscopy, wrote down medical recommendations for post-procedural care on his mobile phone and, forgetting to turn off the recorder, accidentally left the device in the operating room. After listening at home with his wife to what the doctors said during the procedure, when he was under the influence of general anesthesia, the plaintiff decided to go to the district court.

As stated in the statement of claim, doctors began to mock him a second after he fell into unconsciousness. In particular, one of the doctors said that after five minutes of talking with him before the procedure, she wanted to “give him a face in the face so that he would get a little better”, offered to “shoot him in the ass”, and also called him “a jerk” and “a woman .
